(“Cheerity,” or “we” or “us” or “our”), understands your concerns about privacy and your interest in knowing how your information is used and safeguarded, and we want to provide you with more information on these topics. This Privacy Policy (the “Privacy Policy”) describes the practices, policies and procedures related to our website located at www.cheerity.com (the “Website”), including the types of personal information we collect on the Website, how we may use that information and with whom we may share it. Please note that this Privacy Policy applies only Cheerity’s online information-gathering and sharing practices in relation to the Website, and does not apply to any of our practices conducted offline, nor to any of the companies’ or organizations’ websites to which we may link. By visiting the Website, you are accepting the practices, policies and procedures described herein, and you are further indicating that you agree to be bound by the terms of this Privacy Policy. If you do not agree to the terms of this Privacy Policy, please do not visit or use any of the links on our Website. The Information We Collect

Personal Information You Provide And How It Is Used:

Cheerity collects information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly with a particular user or device.
This information is collectively referred to as personally identifiable information (“PII”). In particular, our Website has collected the following categories of PII from its users within the last 12 months:
You may freely visit our Website without being required to provide us with any PII. However, certain requests and features do require that you provide us with some PII (such as your name, email and address), as more particularly described below. We do not knowingly collect sensitive personal information, such as information about medical or health conditions. Please do not send confidential information to us directly through the Website, or by email to any of the contact email addresses listed on the Website.
Registration: You are not required to register in order to browse our Website or participate in a Client’s campaign. However, you will be required to provide personal information in some circumstances in order to access and use certain features and functionality, such as creating a campaign.

Contact Us: We provide a “contact us” link on the Website. If you contact us through the link, we will ask that you provide certain Personal Information, including your first and last name, and email address, and you may have the option to provide additional Personal Information. We may use the information to contact you and to respond to any requests.

Share: If you opt to share information about the campaign you are participating in, or to invite friends to join you, you may be required to provide some Personal Information, which may include your name, email and/or phone number, and a profile picture, if you choose to provide one. Additionally, if you opt to share your activities on our Website via any of your social media affiliations, we will store any applicable tokens, keys or other identifying credentials that you may provide us.

Profile Picture: You will have the option to carry over a profile picture that is associated with the social media account you are authenticating with. Your profile picture will be displayed with your user name on the Website, and will be associated with the activities you undertake on our Website. Such a profile picture will be viewable on the Website and in conjunction with your activities.

Non-Personal Information We Collect by Automated Means:

We collect certain information by automated means when you visit the Website. Much of this information is collected through the use of third-party tracking services, such as Google Analytics. The information collected may include usage information, such as the numbers and frequency of users to the Website, pages visited, web browsing histories, social networking activities and similar data. For example, we may automatically gather the number and frequency of donations made or organizations supported, and build various anonymized profiles. We will also monitor certain user behaviors in order to track the types of causes supported or followed, as well as other activities related to specific campaigns. Additional information collected may also include which URL you just came from, which URL you next go to, what browser you are using, and your Internet Protocol addresses (“IP Address”). This collective, aggregated data helps us determine how much our visitors use parts of the Website, and do internal research on our users’ demographics, interests, and behavior to better understand and serve you. When gathered, this data is used in the aggregate, and not in a manner that is intended to identify you personally. This type of aggregate, anonymized information may be shared with third parties at any time, including advertisers and marketers. In addition to the third-party tracking services mentioned above, we also collect this information through various other means, including “cookies,” “web beacons” and IP addresses, as further explained below.
Cookies – A cookie is a piece of information that a web server may place on your computer when you visit a website. Cookies are commonly used by websites to improve the user experience. Many cookies last only through a single website session, or visit. Others may last up to 90 days. We may use “session cookies” in order to enhance the user experience and for other web-related purposes. These session cookies are not linked to Personal Information. We may also use cookies for other purposes, including to maintain continuity during a user session, to gather data about the usage of our website for research and other purposes, or to store a user name or related login credentials so that you do not have to provide this information every time you return to our Website. Most browsers will tell you how to stop accepting new cookies, how to be notified when you receive a new cookie, and how to disable existing cookies. Please note, however, that without cookies you may not be able to take full advantage of all the features on our Website. Our cookies do not gather Personal Information. In some cases, Cheerity may also use another company to operate web servers for our Website. Cheerity uses the cookie information gathered by these companies in the same manner as stated in this Privacy Policy.

IP Addresses – When you visit and interact with the Website, Cheerity and third parties with whom we have contracted to provide services for us may collect your IP Address, as well as browser type, Internet service provider (ISP), referring/exit pages, platform type, date/time stamp, and page navigation. An IP Address is a unique identifier number that certain electronic devices use to identify and to communicate with each other on the Internet; your Internet Service Provider automatically assigns an IP Address to the computer that you are using. We gather this information to track website visitor movement in the aggregate, and to gather broad demographic information for aggregate use. Our goal in gathering this information is to learn how our customers and the public are using our service. We may use this information to enhance our Website or for other lawful purposes.

Do Not Track – Every time your computer sends or receives information over the Web, the request begins with some short pieces of information called “headers.” These headers include information like what browser you are using, what language your computer is set to, and other details. The Do Not Track technology provides individual users with the ability to include a simple, machine-readable header indicating that they don’t want to be tracked, and sends a signal to Web sites’ visited requesting that the website disable either its tracking or cross-site user tracking of an individual user. Currently, various browsers – including Internet Explorer, Google Chrome, Firefox, Opera and Safari – offer a “do not track” option. Presently, there is no consensus on how Do Not Track should be interpreted, and no common or accepted industry standard for implementing. Consequently, please note that Cheerity’s Website does not currently respond to browsers’ Do Not Track signals, and as such your activities will be tracked, regardless of whether you have opted to enable the Do Not Track option offered by your browser.

How We May Share Your Information

We may disclose all of the information (described herein) that we collect, as stated in this Privacy Policy including in accordance with the terms set forth in this section. Additionally, please note, Cheerity works with a variety of third-party partners/vendors in order to allow us to make the Website available to you, to host and store the information we collect from you, and to provide certain functionality and features; in each case we may share the personal information provided to us with these partners.
We may also use the information we collect from you for ongoing communications related to the various activities of Cheerity. Additionally, we may also use the information we collect from you for various marketing initiatives/purposes; if we do so, we will provide you the opportunity to opt out from such future communications. We may also work with third-party advertisers and “brand” partners for various advertising initiatives, including providing sponsorships, coupons and other related, ad-serving opportunities. We will share your email and any other relevant information you provide to us only with the Client that is the operator of the campaign you choose to participate in and any affiliates if applicable. Otherwise, we do not reveal Personal Information about you to third parties for their independent use unless: (1) you expressly authorize Cheerity to do so, (2) it is necessary to allow Cheerity and its service providers or agents to provide services on Cheerity’s behalf, (3) in order to provide products or services to you, (4) it is disclosed to entities that perform marketing or data aggregation services for Cheerity, (5) it is necessary in connection with a sale of all or substantially all of the assets of Cheerity or the merger of Cheerity into another entity or any consolidation, share exchange, combination, reorganization, or like transaction in which Cheerity is not the survivor, (6) otherwise as Cheerity is required or permitted to do so for any or all of the following reasons: (i) to comply with a subpoena, legal process, government request or any other legal obligation, (ii) to prevent, investigate, detect, or prosecute criminal offenses or attacks on the technical integrity of the Website or our network, and/or (iii) to protect the rights, privacy, property, business, or safety of Cheerity, their partners and employees, the visitors of the Website, or the public.

Children`s Privacy

We are concerned about the safety and privacy of children who use the Internet. This Website is not intended for use by children without parental consent and supervision. We do not knowingly or intentionally solicit data from or market to children under the age of 13, and we only collect information from children between the ages of 13-18 with their parent/guardian’s consent and supervision. If you are a parent or guardian and become aware that your child has provided us information without your consent – or is accessing the Website without your supervision (as applicable) – please contact us at team@cheerity.com to request that we delete such information. We will delete such information from our files within a reasonable amount of time from your request.

How We Attempt to Safeguard Your Information

We maintain administrative, technical and physical safeguards for the Website designed to protect against loss, misuse or unauthorized access, disclosure, alteration or destruction of the personal information that we collect from you. We restrict access to Personal Information collected about you on the Website to our employees, the employees of the Client who operates the campaign you participated in, affiliates’ employees, those who are otherwise specified in this Privacy Policy, or others who need to know that information to provide services to you or in the course of conducting our business operations or activities. When we no longer need your Personal Information, we will make good faith efforts to destroy it by permanently deleting the associated records. If your Personal Information is shared – whether by us or on behalf of us through a vendor – we will endeavor to do so, when reasonably practical, by secure means. However, no website, application or transmission can guarantee security. Thus, while we have established and maintain what we believe to be reasonable procedures to protect the confidentiality, security, and integrity of personally identifying information obtained through the website and we strive to protect your personal information and have asked our third-party vendors to do the same, we cannot ensure or warrant the security of any information you transmit to us. Therefore, you understand, acknowledge, and agree that you transmit certain personal information over this Website at your own risk.

Links to Social Media Sites

We provide links to social media sites, including Facebook and Twitter, as a service to you or in order to provide you additional venues in which you can share content created through Cheerity related to the campaign with which you are involved. Please be aware that we have no affiliation with these other social media sites, and cannot control and are not responsible for the information collection, use, and disclosure practices of such sites; we encourage you to review and understand their privacy practices and policies, if any, before providing any Personal Information to them or using any of their services. We are not responsible for the content or information of these sites, any products or services that may be offered through them, or any other use of the sites.

Your Information and Your Choices

Certain privacy laws around the world, including the European General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA), provide users with rights related to their personal information. Consistent with these laws, we provide you with reasonable access to the PII you provide to us. While some of these rights apply generally, certain right apply in limited cases:
Right to Correction – If you believe that any of the PII that you have submitted through our Website is no longer accurate, or you wish to make any updates or changes, you have the right to request that we rectify inaccurate information about you.

Right to Restrict Processing – Under certain circumstances where we process your information, you may also have the right to restrict or limit the ways in which we use your PII.

Right to Object – If we process your information based on our legitimate interests as explained above, you can object to this processing in certain circumstances. In such cases, we will cease processing your information unless we have compelling legitimate grounds to continue processing or where it is needed for legal reasons. Where Cheerity or the Client who operates the campaign you participated in uses your PII for direct marketing purposes, you can object using the unsubscribe link in such communications or changing your account email settings.

Right to Withdraw Consent – Where we rely on consent, you can choose to withdraw your consent to our processing of your information using specific features provided to enable you to withdraw consent, like an email unsubscribe link or your account privacy preferences. If you have consented to share your precise device location details but would no longer like to continue sharing that information with us, you can revoke your consent to the sharing of that information through the settings on your mobile device. This is without prejudice to your right to generally permanently delete your PII.

Please contact us at team@cheerity.com to request that we update your Personal Information. Upon appropriate request and if commercially reasonable, we will update, amend or delete your information, and we reserve the right to use information obtained previously to verify your identity or take other actions that we believe are appropriate and lawful.

Limiting use or deleting your Personal Information may impact Website uses that rely on that information. However, we will not discriminate against you for exercising any of your rights, including otherwise denying you services, or providing you with a different level or quality of services. The following additional rights apply solely to all user who reside in the State of California, in accordance with the CCPA:

Right to Know – California residents may request disclosure of the categories and specific pieces of PII that Cheerity has collected about them, including the categories of sources for that personal information, the business or commercial purposes for collecting the information, the categories of PII that we have disclosed, and the categories of third parties with which the information was shared.

Right to Opt-Out – To the extent that Cheerity “sells” personal information, California residents are entitled to opt-out of the “sale” of data at any time. Cheerity does not sell personal information to third parties for monetary value. However, the term “sale” is defined broadly under the CCPA. To the extent that “sale” under the CCPA is interpreted to include interest based advertising or other data uses described in the “HOW WE MAY SHARE YOUR INFORMATION” Section above, we will comply with applicable law as to those activities.

Data Retention

Cheerity will use your data only as long as is necessary to manage your participation in a Client’s campaign or as required to comply with legal or regulatory obligations. When Cheerity no longer needs your personal information for any of the above purposes, the Company will remove it from its systems. This will generally be one (1) years after you participate in a campaign. If we keep data longer, it would be to satisfy legal or regulatory obligations and the Cheerity’s legal basis would be relevant laws or regulations.

Use of the Website from Outside the US

We do not represent or warrant that the Website, or any part thereof, are appropriate or available for use in any particular geographic location. If you choose to access our Website, you do so on your own initiative and at your own risk, and are responsible for complying with all local laws, rules, and regulations applicable in your jurisdiction. Please note that the Website is hosted in the United States and is governed by United States law. If you are visiting the Website from outside the United States, please be aware that your information may be transferred to, stored and processed in the United States where our servers are located and our central database is operated. The data protection and other laws of the United States and other countries might not be as comprehensive as those in your country. By using the Website, you consent to your information being transferred to our facilities and to the facilities of those third parties with whom we share it as described in this privacy policy.

Governing Law

You agree that your use of the Website, this Privacy Policy, and any disputes relating thereto, shall be governed in all respects by the laws of the State of New York. Any dispute relating to this Privacy Policy shall be resolved solely in the local, state or federal courts located within the state of New York.

Changes to Our Privacy Policy

We reserve the right to revise this Privacy Policy at any time by updating this posting. Please check back regularly and to see if there have been any changes to this policy, which you can determine by reviewing the Effective Date at the top of this page.
